Article 1. About us

These conditions of sale are applicable to the merchant website AMOIPARFUMS.FR managed by the company THE FEEL GOOD BEAUTY with share capital of €30,000 having its registered office Head office at 5 Bis avenue Marcel Proust CS 80062, 28,000 Chartres and registered with the Chartres RCS under number 951 809 425 (hereinafter, the “Seller”) which markets products to consumers and buyers (hereinafter, the “Customer”).

By using this site, you acknowledge having read these conditions and having accepted them.

Article 2. Purpose

These conditions of sale aim to define the contractual relations between THE FEEL GOOD BEAUTY and the Buyer and the conditions applicable to any purchase made via the amoiparfums.fr website.

The acquisition of a product through this site implies unreserved acceptance by the Buyer of these conditions of sale, of which the buyer acknowledges having read prior to his order.

Before any transaction, the Buyer declares on the one hand that the purchase of products on the site amoiparfums.fr is not directly related to his professional activity and is limited to strictly personal use and on the other hand to have full legal capacity , allowing it to commit to these general conditions of sale.

THE FEEL GOOD BEAUTY company retains the possibility of modifying these conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.

Definitions:

“User” means any legal or natural person who uses this Site.

“Buyer or Buyers” means the Consumer who has placed an Order for a Product sold on the Website;

“Order” means any order placed by the User on this Site and registered for this purpose on it;

“General Conditions of Sale or General Conditions of Sale” means these general conditions and online sales conditions;

“Products” means material things which may be the subject of appropriation and which are offered for sale on this Site;

“Site” means this website, i.e. AMOIPARFUMS.FR

“Company” means the company THE FEEL GOOD BEAUTY, more fully described in article 1 hereof.

Article 3. Products

The Products offered are those which appear on the Site, while stocks last. The Company reserves the right to modify the product assortment at any time. Each product is presented on the Website in the form of a description listing its main technical characteristics (capacity, use, composition). The photographs are as faithful as possible but do not commit the Seller in any way. The sale of products presented on the AMOIPARFUMS.FR Site is intended for all Buyers residing in countries which fully authorize the entry into their territory of these products.

The buyer declares to have full knowledge of the provisions of the product and agrees not to engage the seller's liability subject to the application of mandatory legal provisions.

Article 4. Price and VAT

The prices of the products are those appearing on the site on the day of its consultation by the customer. The prices of the products are indicated in euros and are inclusive of tax, excluding delivery costs which remain the responsibility of the customer unless mentioned or special conditions. Countries in the European community are taxed at the current VAT rate. Other countries are exempt and pay duties upon entering the territory. Tax calculation is fully automated by the system.

Customs fees:

Your order will be shipped from our logistics provider in France.

For member countries of the European Union, no customs fees will therefore be applied.

Outside of these countries, customs fees may be applied by the customs of the country of delivery. Their amount may vary depending on the country in question.

Article 5. Process for placing an order

The User completes their order by completing the following six steps:

Step 1. Create your customer account, indicate your username and the associated password, or

Step 2. Add the selected Product(s) to your cart. Access to the basket is possible at any time for modification or validation.

Step 3. Validate your basket after checking its contents

Step 4. Access your account to confirm and complete the contact details necessary for delivery. If the customer does not already have an account on the Site, create their customer account and fill in the required information regarding their identity

Step 5. On the order summary page, expressly accept the Site's general conditions of sale.

Step 6. Finally, the customer will be redirected to the secure online payment site to validate the payment. The customer's final acceptance is therefore materialized by the validation of their banking details (bank card number, expiry date and cryptogram). The placing of an order by the customer implies the latter's full and unreserved acceptance of these general conditions of sale.

Order confirmation :

When your order is transmitted, you will receive an email confirming your order including the registration of your order, details of the items ordered, personal data including the address and delivery method. No cash on delivery orders or payment by money order.

Order tracking :

To follow the progress of the processing of your order, go to “My account” in the online catalog. After identifying yourself, you will be able to view the status of your orders.

“Unprocessed”: your order is still being prepared.

“Processed”: your order is ready to be collected by our carriers. You will soon receive an email from the carrier telling you that it has been collected.

Archiving orders:

The customer's basket is archived and kept for a later order for a period of 30 days, even in the event of an interruption of the internet connection. Order details are archived in accordance with article L.134-2 of the Consumer Code, for a period of ten years on a secure server. However, no credit card numbers are stored. The customer accepts that the order confirmation is considered proof of the contractual relations between the Parties.

Article 6. Secure payment

THE FEEL GOOD BEAUTY has set up a secure payment system for all orders placed on the e-boutiqueamoiparfums.fr.

The customer can pay for their order using different payment methods:

By credit card :
Visa, Master Card, CB cards. All credit card numbers are 128-bit encrypted by the software when the order is placed. Orders delivered outside mainland France are payable exclusively by credit card. Secure payment.

By PayPal:
Your payments are made directly on the PayPal website via pages encrypted using the SSL (Secure Socket Layer) protocol. Amoi does not have access to your bank details under any circumstances.

Article 7. Delivery time and shipping costs

The Customer will be informed by email of the delivery of the package with the package tracking number. Shipping costs are calculated automatically at the end of your order based on the delivery location.

Delivery times do not include preparation times, which may therefore result in a few days difference in receipt of your order.

In addition, delivery times are the sole responsibility of the carriers and under no circumstances can THE FEEL GOOD BEAUTY be held liable in the event of non-compliance with delivery times.

Article 8. Reservation of title

THE FEEL GOOD BEAUTY retains full ownership of the products sold until full payment of the price, in principal, fees and taxes included.

Article 9. Anomaly upon delivery

Upon delivery of the order, the customer must check the conformity and condition of his order and, if necessary, issue any useful reservations concerning apparent defects (missing product, damaged package).

The goods are transported under the responsibility of the customer. The latter must refuse a package presenting anomalies or a presentation which could suggest partial or total deterioration of the goods or theft. In the event of a return by La Poste following refusal of receipt due to damage to the package, the order is reshipped free of charge and in good condition to the customer.

The customer must declare by email or any other written means any error or anomaly or poor workmanship concerning the items received within 48 hours of receipt of the package. You must contact us via our contact form , specifying the subject of your complaint with your Internet order number.

In the event of a return sender of packages, for non-complaint to the post office or relay point within 15 days; you will be refunded the amount of the price of your order from which we deduct €10. The amount refunded therefore represents the initial amount of your order from which we have subtracted the management fees from your order, i.e. €10.

Article 10. Withdrawal

Under article L121-20 of the Consumer Code, the Buyer has a period of fourteen working days from delivery of their order to exercise their right of withdrawal and thus return the product to the Seller for refund without penalty, except for return shipping costs.

To return a product, you must contact customer service and notify them of the desired return, before sending the package at your expense. Our customer service will tell you the steps to follow.

The return can only be made if the product has never been opened and used, in impeccable condition, as you received it. Items must be returned in their original packaging, accompanied by supporting documents. Items returned incomplete, damaged, damaged or soiled by the customer are not taken back, they will be reshipped at your expense.

When returning, if the items comply, all costs are refunded with the exception of additional delivery costs chosen by the consumer.

Don't forget to include with your shipment:

- copy of the invoice,

- the defective product or item correctly packaged,

- the return form that you have duly completed and signed.

Article 11. Guarantee

In accordance with the legal provisions in force relating to the conformity of the property with the contract, in terms of hidden defects. In the event of non-conformity of a product sold, it may be returned to THE FEEL GOOD BEAUTY company which will take it back, exchange it or reimburse it within a maximum of two years from the delivery of the good. The company also reimburses the full return costs upon presentation of supporting documents.

The buyer may decide to implement the guarantee against hidden defects in the item sold within the meaning of article 1641 of the civil code. In this case, he can choose between canceling the sale or reducing the sale price in accordance with article 1644 of the civil code.

Reimbursements for Products deemed non-compliant or defective will be made as soon as possible and at the latest within fourteen (14) days following the Seller's discovery of the lack of conformity or hidden defect. Reimbursement will be made by credit to the Customer's bank account or Paypal account.

The Seller's liability cannot be incurred in the event of non-compliance with the legislation of the country in which the Products are delivered, which it is up to the Customer to verify, or in the event of misuse, negligence or lack of maintenance of the on the part of the Customer, as in the event of normal wear and tear of the Product, accident or force majeure.

The Seller's guarantee is, in any event, limited to the replacement or reimbursement of non-compliant or defective Products.

The replacement of the Products does not have the effect of extending the duration of the warranty.

Products modified, repaired, integrated or added by the buyer are excluded from the warranty. The warranty does not cover apparent defects. The warranty will not cover products damaged during transport or due to misuse.

Guarantee implementation method:

When acting as a legal guarantee of conformity, the Buyer:

Benefits from a period of two years from the delivery of the property to take action;

Can choose between repairing or replacing the goods, subject to the cost conditions provided for by article L217-9 of the Consumer Code;

Is exempt from providing proof of the existence of the lack of conformity of the goods during the six months following delivery of the goods. This period is extended to twenty-four months from March 18, 2016, except for second-hand goods.

The legal guarantee of conformity applies independently of the commercial guarantee which may possibly cover the Product. The Customer may decide to implement the guarantee against hidden Product defects in accordance with article 1641 of the Civil Code; in this case, he can choose between canceling the sale or reducing the sale price in accordance with article 1644 of the Civil Code.

Article 12. Liability

The company THE FEEL GOOD BEAUTY in the distance selling process is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems.

In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, THE FEEL GOOD BEUATY adheres to the E-commerce Mediator Service of FEVAD (Federation of e-commerce and distance selling) whose contact details are as follows : 60 Rue La Boétie – 75008 Paris – http://www.mediateurfevad.fr . After prior written action by consumers vis-à-vis THE FEEL GOOD BEAUTY, the Mediator's Service may be contacted for any consumer dispute for which the settlement has not been successful. Article 13. Intellectual property

All elements of the Site are and remain the intellectual and exclusive property of THE FEEL GOOD BEAUTY company. The user is not authorized to reproduce, exploit, or use for any reason whatsoever, even partially, elements of the Site, whether in the form of a photo, logo, visual or text.

Article 14. Personal data

THE FEEL GOOD BEAUTY company undertakes to preserve the confidentiality of the information provided by the Buyer, which he may be required to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978 and European Regulation 2016/679. As such, the Internet user has the right to access, modify and delete information concerning him or her. He can request it at any time via our contact form . THE FEEL GOOD BEAUTY processes consumer information in accordance with its Privacy Policy .

Article 15. Applicable law

These distance selling conditions are subject to French law.

Annex

Provisions relating to legal guarantees

Article L. 211-5 of the Consumer Code: “To comply with the contract, the good must:

1/ Be suitable for the use usually expected of a similar good and, where applicable:

-correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;

- present the qualities that a buyer can legitimately expect having regard to public declarations made by the seller, by the producer or by his representative, in particular in advertising or labeling;

2/ Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted. »

Article L. 217-4 of the Consumer Code: “The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility. »

Article L. 217-9 of the Consumer Code: “In the event of a lack of conformity, the buyer chooses between repair and replacement of the good. However, the seller may not proceed according to the buyer's choice if this choice results in a cost that is manifestly disproportionate with regard to the other method, taking into account the value of the goods or the importance of the defect. He is then required to proceed, unless impossible, according to the method not chosen by the buyer. »

Article L. 217-12 of the Consumer Code: “The action resulting from the lack of conformity is prescribed two years from the delivery of the good. »

Article L. 217-16 of the Consumer Code: “When the buyer requests from the seller, during the course of the commercial guarantee which was granted to him during the acquisition or repair of movable property, a discount in a condition covered by the warranty, any period of downtime of at least seven days is added to the remaining warranty period. This period runs from the buyer's request for intervention or the making available for repair of the goods in question, if this making available is subsequent to the request for intervention. »

Article 1641 of the Civil Code: “The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the buyer does not would not have acquired, or would have only given a lower price, if he had known them. »

Article 1643 of the Civil Code: “He is liable for hidden defects, even if he is not aware of them, unless, in this case, he has stipulated that he will not be obliged to provide any guarantee. »

Article 1644 of the Civil Code: “In the case of articles 1641 and 1643, the buyer has the choice of returning the thing and having the price refunded, or keeping the thing and having part of the price returned, such as that it will be arbitrated by experts. »

Article 1648, paragraph 1, of the Civil Code: “The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect. »
